From 1 July 2011, company directors are personally liable for their company’s failure to pay employee superannuation guarantee amounts unless the individual engaged by the company is a contractor. Whether or not an individual is a contractor or employee is a question of law. Clients are advised to seek legal advice to determine if any individual is an independent contractor and if so, changes should be made to their contracts to minimise risk of liability.
