On 6 February 2013, the High Court overturned the decision of the Full Federal Court against Google brought by the ACCC. The High Court held that Google was not responsible for misleading links by advertisers on the grounds that Google simply acted as a conduit between advertisers and search users. Google did not control a user's choice of search terms or an advertiser's choice of keywords.

The case shows advertisers rather than website administrators are responsible for information displayed on the web. However, businesses promoting the goods and services of a third party should ensure that with any information provided to the public from a third party, it is apparent that they are merely passing on the information and not making any representations as to the accuracy of the information.
